When a player gets too powerful toy, make it cursed. Or do your best to break it. Or both.

Don't make it cursed. A weapon or item way to powerful for the player probably has a reputation, as does the person who previously weilded it. As such the campaign shifts to every person in the world who wasn't good enough to take the item from the person who weilded it gradually finding out that a worthless peon now has it and deciding to take it from them. Thievery is an acceptable manner of taking it but now the most powerful level 20 npc's are gunning for the player.

Considering how often I get "If I find it too difficult to balance against your character I'm smiting it" or something to that effect I always end up wondering how powergamers in these things get away with it...

They have creative GM's who aren't a**holes. Also the powergamers are that for a reason. Anything beyond actually saying "you die" gives the PC a chance. Being a power gamer or min maxer isn't just about figuring out how to break the game. It's about having the skill to keep breaking it. No fast talking involved. Just take the character you got away with making and figure out how to compensate for all the flaws you took.
